I agree with your fine goal, but I doubt that law would automatically change much. We need systems to clearly document such candor, with confirmation pt received & underdstood it. A robust whistleblower protection & reward system might also help. Otherwise informal suppression of candor would likely persist, as do many illegal acts.
Health care quality and safety suffer tremendously when administrators lack the courage and ethics to make such difficult decisions. The temptation to avoid conflict and bad PR all too often trump both, choices that make such administrators equally repsonible to poor providers for patient injury and death.
