Nurses transferred to private providers could lose the right to retain their NHS employment terms and conditions under changes being considered by ministers.

Chancellor George Osborne said last week the government would “complete a call for evidence on the effectiveness of the TUPE (Transfer of Undertakings – Protection of Employment) regulations”.

TUPE rules protect staff transferred to a new employer, but the government wants to review them as part of plans to reform employment law. It will consult on proposals for TUPE changes in early 2012.

A separate consultation on the “fair deal” policy, which ensures staff retain a broadly comparable pension when they are transferred out of the NHS, has already been carried out and a government response is awaited.

It is expected to result in the deal being binned, making it easier for private companies to compete for NHS business.
